A health care power-of-attorney is a form of durable power of attorney.
It is a written document by which an adult can give authorization to another trusted adult to make health care and other decisions if the person becomes unable act so for himself or herself.
What is allowed can be broad or limited. It may include financial, care and other decisions, or only making health care choices you are not able to make because of your condition.
This may be used to appoint another trusted adult to act in your best interests and as you would act in making decisions only when there is an inability to make those decisions yourself.
You may also request that trusted adult be appointed your guardian or conservator — if that becomes necessary. A court must confirm a request for guardian or conservator appointment, but will usually follow your request.
A trusted family member such as a child, brother, sister, aunt, uncle, mother or father are usually chosen.
The power of attorney must be signed while mentally competent and rational. It is called durable because it is not invalidated by later mental incapacity or inability to make rational decisions.
