Utah law provides that you may only sign a Living Will if you are an adult (over the age of 18). If you are unable to sign a Living Will, someone else (a proxy) may sign on your behalf. There must be two witnesses to the signing who are both adults. Those witnesses cannot be related to you by blood or marriage. A blood relation includes children, parents, brothers, sisters, aunts, uncles, etc. A marriage relation includes your spouse, your inlaws or their family members. The witnesses cannot be heirs under the laws of intestacy or under a will. A witness cannot be an agent or employee of a health care facility which is providing treatment or care for you. A witness cannot be financially responsible for your care. A proxy cannot be a witness.

If you are pregnant, the terms of a Living Will are of no force and cannot be followed while you are pregnant.

What is commonly called a Living Will may be more than one document and in Utah may include a:

  1. Directive for Medical Services — directing the withholding of medical services under specified conditions. This is a common 'Living Will' under Utah law, and is called a 'Living Will' on this website..
  2. Directive for Medical Services after injury or illness is incurred — directing the withholding of medical services after an illness or injury under specified conditions. This is called an 'Alternative Living Will' on this website.
  3. Special Power of Attorney — allowing an agent to make a directive for medical services (living will) for another person.
  4. Emergency medical services directive — Directive not to resuscitate.
  5. Written concurrence providing for withholding life-sustaining procedures from terminal persons without a directive.
